Terms and Conditions of Service

1. Object and scope
These Terms and Conditions govern the hiring of web design, development and delivery services offered by Javier MKT («the Provider»), in particular the AstroStart Core and Business Growth plans, as well as the relationship with the client («the Client») from the time of acceptance of the quote or payment.
2. Service process
- Contracting and payment. The Client contracts by paying through the indicated gateway (Stripe). Payment may be made in full or in two instalments, as chosen.
- «Empecemos» form. After payment, the Client must complete the briefing form («Empecemos») with their business data, competitors, references and preferences. Failure to provide this information within a reasonable time may delay the start of the project.
- Initial meeting. A meeting (video call or similar) will be scheduled to align expectations, clarify doubts and set the work plan. Scope and timelines are confirmed at this stage.
- Design and development. The Provider produces a first version of the site (design and/or prototype) based on the briefing. Revisions will be carried out at agreed stages (typically 1–2 rounds of feedback included, depending on the plan).
- Content. Integration of final texts, images and other content is the Client’s or the Provider’s responsibility as agreed in the briefing. The Client agrees to provide content within the indicated deadlines so as not to delay delivery.
- Delivery and publication. Once the final version is approved, the Provider deploys to the agreed hosting (e.g. Vercel, Netlify) and configures the technical setup (domain, SSL, etc.) as provided for in each plan.
- Post-delivery support. A period of support for minor corrections after delivery (e.g. 30 days) is included, under the specific terms of the plan.
3. What the service includes
- Design and layout of the site according to the briefing and references provided.
- Development with the indicated tech stack (Astro and integrations described in each plan).
- Hosting on a static hosting platform (e.g. Vercel/Netlify) for the first year or as described in the plan.
- Legal texts (legal notice, privacy, cookies) in template form adapted to the project, when included in the plan.
- Setup of measurement or marketing tools (e.g. Google Analytics, Google Ads) when part of the Business Growth plan.
- Basic SEO optimisation (titles, meta descriptions, schemas) within the scope of the initial delivery.
- A limited number of revisions and changes as agreed in the quote; changes beyond that scope may incur additional charges.
The exact scope of each plan is set out in the quote or on the pricing page in force at the time of contracting.
4. What is not included (unless expressly agreed)
- Full editorial content (long-form copy, in-depth copywriting, professional photography) except as agreed.
- Integration with external systems (ERPs, CRMs, payment gateways other than those indicated) not described in the plan.
- Maintenance, content updates or support beyond the included period, unless separately contracted.
- Domain registration or domain costs, unless otherwise stated in the quote.
- Work arising from scope or briefing changes requested after the quote has been closed.
5. Client responsibilities
- Provide the «Empecemos» form information and required content (texts, images, logos) in the indicated format and on time.
- Respond within a reasonable time to requests for feedback and approval; delays attributable to the Client may affect delivery deadlines.
- Ensure they have rights to the content they provide (texts, images, trademarks) and that it does not infringe third‑party rights.
- Provide access to domains, hosting accounts or tools (e.g. Google) when necessary for deployment and configuration.
- Communicate clearly and in writing (email) any change in scope or requirements so that impact on timelines and price can be assessed.
6. Timelines
Delivery timelines are set in the quote or at the initial meeting from the payment date and receipt of the complete briefing. They are indicative and may be affected by the Client’s availability to provide content and feedback, by scope changes or by force majeure. The Provider will inform of significant delays to the extent possible.
7. Refund guarantee
The Client may request a full refund of the amount paid if, after the first meeting or within the first 15 days of contracting, they do not wish to continue. The refund will be made without questions and at no extra cost, upon request by email. After that period or once design/development has progressed substantially, this refund guarantee does not apply, without prejudice to any rights the Client may have under consumer law.
8. Intellectual property and use
Once the price has been paid in full, the Client receives rights of use over the website developed for their project (code, design and materials delivered within the scope of the commission), on the terms set out in the quote or an annex. The Provider reserves the right to use the project anonymously in its portfolio or in promotional material unless otherwise agreed.
9. Confidentiality
Both parties undertake to treat as confidential any sensitive information exchanged in the course of the project (business data, strategies, access details) and not to disclose it to third parties without prior consent, except where required by law.
10. Limitation of liability
The Provider is liable for the proper performance of the services within the contracted scope. It shall not be liable for indirect damages, loss of profits or data, or for harm arising from the Client’s or third parties’ use of the site, from the quality of content provided by the Client, or from issues with external services (hosting, domains, third‑party APIs) outside its control.
11. Changes to these Terms
The Provider may update these Terms and Conditions. The applicable terms are those in force at the time of contracting. Material changes to services already contracted will be communicated and, where appropriate, reflected in an annex or new version accepted by the Client.
12. Governing law and dispute resolution
These Terms are governed by the laws of Spain. For any dispute, the parties submit to the courts of the Client’s place of residence when the Client acts as a consumer; otherwise, to the courts of A Coruña.
